1. The data you provide is collected by Immigration Service Delivery (ISD), a part of the Department of Justice, Home Affairs and Migration (DoJHAM). How will your personal data be used?
2. We may use the personal data you provide in this form for the following purposes:
- Processing, progressing, assessing eligibility and/or corresponding with you in respect of any application(s) made by you for immigration permission(s), or for any application(s) made on behalf of a minor, update and provide you with information on your application(s), whether for you or on behalf of a minor;
- Examining and analysing your correspondence;
- Finding out information to assist in answering your correspondence;
- If applicable, verifying your identity;
- If applicable, verifying your address;
- Addressing any queries, suggestions, issues or concerns and responding to your correspondence as appropriate, and
- We may also use the personal data provided by you and in associated correspondence as part of any future considerations regarding your immigration or citizenship status.
2 (b). Account setup and identity verification:
- To verify your identity during account setup, you will be required to download the ID-Pal app;
- ID-Pal is an Irish registered company with data stored on EU-Based servers;
- ID-Pal uses technology to compare two facial images – the face in an identity document and the face of the person completing the process;
- The involves a 50-point biometric facial comparison of the two images;
- Once verified, customers complete the account creation process;
- The data will only be retained until identity has been verified or failed to verify;
- ID-Pal do not retain any copies of the images or data, which undergo verification checks on their servers.
Legal Basis for processing your Personal Data
3. Our legal basis for collecting and processing this data is as follows:
- To carry out a task in the public interest. We are obliged to collect and process this data to ensure the effective and efficient operation of the immigration services of Ireland, which fulfils an important public interest.
- To protect the integrity of the immigration process and to ensure that the proper enactment of all immigration schemes are complied with in the exercise of the executive power of the State in relation to immigration, vested in the Government by the Constitution.
- To fulfil the function of the Minister for Justice (Management of inward migration to the State (Immigration)) as designated in the Ministers and Secretaries Act 1924 (as amended).
Further processing of your Personal Data
4. Where it is necessary and proportionate to do so, in accordance with the Data Protection Act 2018 and the GDPR, further personal data may be requested or received from/provided to other Public Authorities/competent authorities / international organisations for the purpose of:
- Section 8 of the Immigration Act 2003,
- Section 41 of the Data Protection Act 2018.
- Verification of the data received under Directive 2004/38/EC, Regulation 26 of the EC (Free movement of Persons) Regulations 2015 as amended, EU (Withdrawal Agreement) (Citizens’ Rights) Regulations 2020, section 3 of the Immigration Act 1999.
- Work Permit application for non-EEA nationals in accordance with Section 37 of the Employment Permits Act 2006;
- Processing applications for residence - Section 261(2) of the Social Welfare Consolidation Act and Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2020;
5. We may also process your personal data for research or statistical purposes as allowed under the Data Protection Act 2018 and the GDPR.
6. The DoJHAM is committed to providing efficient and effective services to our customers. We may use your contact details (email address etc.) to gain a deeper understanding of your experience with the DoJHAM by way of an anonymous survey. You may receive this survey after your interaction with the DoJHAM has concluded.

How long will Personal Data be retained?
8. This data will be stored in accordance with the requirements of the National Archives Act 1986.
- Data uploaded for the purpose of identity verification at the account verification stage will be deleted once verification is complete.
How to Request a copy of your Personal Data
9. You can request a copy of your personal data by completing a Subject Access Request (SAR) form, available:
- At https://www.gov.ie/en/organisation-information/fd31f0-protecting-personal-data-in-the-department-of-justice/ or
- from the Data Protection Support and Compliance Office (DPSCO) at the address below.
Forward the completed form by email to subjectaccessrequests@justice.ie or by post to the DoJHAM Data Protection Officer at the address below. You will be required to verify your identity before the data can be forwarded to you. The time limit for responding to a SAR commences once your identity has been verified.
Your Rights in relation to your Personal Data
10. You have the right to rectify any inaccuracies in your data. To do this you should submit a query via the “Queries” tab in your Irish Immigration Account, or, write to Customer Service Function, Immigration Service Delivery, Department of Justice, Home Affairs and Migration, 13-14 Burgh Quay, Dublin 2, D02 XK70 documenting the inaccuracies which need to be rectified. The right to rectification is not absolute and each request will be considered on its own merits.
11. You have the right, where appropriate, to obtain erasure of your data and/or a restriction on the processing of your data as well as the right to object to the processing of your data.
